about these terms

These Terms of Service ("Terms") govern your use of the software applications, tools, bots, and websites published by Nathan B. ("py.", "we", "us") — collectively the "Services", including pyth.co.za. By downloading, installing, or using any of the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. who can use the services

You must be old enough to form a binding agreement in your jurisdiction (and at least 13). If you use the Services on behalf of an organization, you confirm you're authorized to accept these Terms for it.

2. licence to use the services

Some of our apps are open-source and are distributed under their own licence — see each project's repository and LICENSE file, which governs your rights to that project's source code. Separately, these Terms govern your use of the official Services and builds we distribute. The names, logos, and branding of py. and its apps are not licensed for reuse and remain ours (see the Disclaimer and each project's notice).

3. acceptable use

You agree not to:

• use the Services to break the law or to infringe anyone's rights;
• use the Services in violation of the terms, rules, or rate limits of any third-party service they connect to — you are responsible for your own conduct on those platforms;
• misuse, overload, attack, or attempt to gain unauthorized access to the Services or related systems;
• redistribute modified builds under our name or in a way that implies they are official or endorsed by us (rename your fork — see the Disclaimer).

4. third-party services

Some Services interoperate with third-party platforms and data sources that you choose to use. We don't control those services, aren't responsible for them, and don't guarantee their availability or accuracy. Your use of them is subject to their own terms and policies.

5. no professional or financial advice

The Services provide information, estimates, and tools for convenience only. Nothing in the Services is financial, investment, legal, or other professional advice. Where a Service deals with virtual or in-game items, no real-world currency is involved. Any figures, recommendations, or analytics are estimates that may be wrong or out of date — verify before you act and make your own decisions.

6. disclaimer of warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, whether express, implied, or statutory, including (to the maximum extent permitted by law) implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or that any data or estimate they show is accurate or current.

7. limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NATHAN B. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR VIRTUAL/IN-GAME ITEMS, ARISING FROM OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. Because the Services are provided free of charge, our total aggregate liability for any claim relating to the Services is limited to the greater of the amount you paid us for them (which is typically zero) or the minimum amount required by applicable law. Nothing in these Terms excludes liability that cannot lawfully be excluded.

8. your responsibility & indemnity

You are responsible for how you use the Services, for your conduct on connected third-party platforms, and for keeping your own data backed up. You agree to indemnify and hold us harmless from claims arising out of your misuse of the Services or your violation of these Terms or applicable law, to the extent permitted by law.

9. availability, updates & changes

We may modify, update, suspend, or discontinue any Service (or any feature) at any time, including via automatic updates. We may also update these Terms; material changes take effect when posted with a new effective date, and continued use means you accept them.

10. termination

You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms or misuse the Services.

11. governing law

These Terms are governed by the laws of South Africa, without regard to conflict-of-laws rules, and you agree to the courts of South Africa as the venue for disputes, except where applicable consumer-protection law gives you the right to bring a claim elsewhere.
